i can't help but picture my baby -- i'm sorry. really emotional there. we'll key you in on that story in a moment. i'm christi paul. happy hump day t you is being happy to you. i want to let you know we've got pictures and videos that show -- we don't have them, but these are what's being -- these are the videos from the court today. pictures and videos that show the drowning death of a whale trainer at sea world will not be made public at least not yet because an orlando judge is extending the temporary restraining order that keeps the images sealed. so the decision is not yet final. police collected the videos and pictures while investigating the death of dawn brancheau last month. her family is trying to prevent them from going public. media outlts argue they are public pictures since they were used by police in their investigation and they say the state's open records act requires they be made public. the sdwr is keeping the taemp rare injunction in place while he decides whether to make that permanent. the california state medical

board thinks the doctor who was present when michael jackson died should not be allowed to practice medicine in that state. court documents reveal next month the board will ask a judge to order dr. conrad murray to stop practicing while he's being prosecuted for involuntary manslaughter. the documents claim murray was reckless when he gave a lethal dose of proef fol to the pop superstar. the l.a. county coroner conclude jackson died from an overdose of the powerful anesthetic. they pride to have his him denied but they ordered him not to use any anesthesia on patients. we want to go to vinnie politan from trutv for more on this. so is this coming from the medical board. they want to shut him down or coming from california's attorney general. >> california's attorney general, jerry brown. he's really been very proactive in talking about all these

doctors and prescription shopping and all that. that's been a big issue for jerry brown as attorney general. and that's part of the reason i think he's doing that. part is politically motivating. we're talking about it a lot of people are talking about it. for dr. conrad murray, he's not really practicing in california. that's not where his day-to-day practice is. >> he's in texas, right? >> in texas and nevada as well. so it's not going to impact him that way. but where it impacts him is in the court of public opinion. and that is the real concern for dr. conrad murray here. >> that was my question. in terms of jurors, once they sit down in this courtroom, what is the bearing, i guess? what's the connection? >> it's the headline today. they are talking about it, yanking his license. if his licen gets yanked away it's because he did something wrong. so you go from point "a" to point "b." if i judge has already said he's done something wrong and has taken away his license and the attorney general is after him. it doesn't help him. you have to find jurors who can

put that aside. >> this is an unprecedented case in the scope of it. it's involving michael jackson, involve. but is there a precedent? is it common for a doctor who is under this kind of scrutiny to have his license pulled before he's even been convicted? this man is not convied of anything. >> absolutely. it's two different jurisdictions you are talking about. your license to practice law versus your liberty. your ability to do whatever you want, to walk around the streets of california. or walk around anywhere else. if, in fact, they take his license away, he can't practice medicine in california. and it's a different level of burden of proof. in a criminal case to prove he did something here illegal and criminal, it's beyond a reasonable doubt. to take away his license is much less of a burden. so will he fight this? probably not. because he doesn't practice in california anyway. i doubt he wants to speak about this before he gets in front of a criminal judge in a criminal court. >> i want to get to the seaworld question. the video of the death of dawn

brancheau. it's being held by a judge. some are fighting to make that video public. is there a precedent for this? by law. by florida law, certainly it looks as though it could be released. >> under florida law -- >> but morally people are saying we don't want to see and we don't want the family to go through the sight of seeing this woman's death splashed all over tv screens and the internet. >> you have the florida -- the sunshine laws in florida. something becomes part of a criminal or an investigation by police it becomes a public record. in florida, they like everything public to be public which means the media has access to it. the media on the -- the family has concerns. we don't want this paraded and we don't want it thrown all over the internet for people to watch for entertainment value. so we understand that concern. there is precedent here because the autopsy of dale earnhardt jr., there were motions to seal that and that was sealed. so a judge could perhaps prevent the public from ever seeing this. now from the media perspective, you know, like the "orlando sentinel" is involved. they don't necessarily want to

show this video to the public, but they want to see the video so they can determine what really happened here. because there are conflicting reports and conflicting eyewitness reports on what exactly happened to this woman, to this trainer. so there some are valid concerns from the media and valid concerns, obviously, from the family and seaworld is sort of jumping on with the family saying it's our video. we don't want it disseminated out there as well. >> okay. thank you so much, vinnie politan with "in session." always a pleasure to have you here. >> right next door. >> we love it. just a short walk. okay. police at a florida middle school say a student -- this is unbelieve -- continued texting his friends just after allegedly punching and stomp on a teenage girl with his steel-toed boots until she was nearly dead. the 15-year-old boy attacked 15-year-old josie lou ratley outside their school last week. she's in the hospital in critical condition. the broward county sheriff says a text message from ratley

apparently enraged the teen and he texted back "i am coming over there and i'm going to snap your neck." the sheriff says after the attack -- remember after the attack this is, the teen sent another message to his friends that said "well, i guess i'm going to prison. i almost killed somebody." the incident apparently started after ratley loaned her phone to a 13-year-old girl. police say she's the one who pointed out ratley to the suspect. they later arrested that 13-yeaold girl and charged her as an accessory to attempted murder. ratley's aunt told hln's jane velez-mitchell that her niece barely knew the girl but wanted to help her. >> this little girl is just an acquaintance of hers, someone she was nice enough to lend the phone to and became a victim over, you know, an issue where -- one thing about my niece, i have to say. she's a very sweet, loving, caring person. and i'm not saying this because i'm her aunt.

i will say that she's an abnormal child in today's time because of all the violence that's out there. she actually id to the little girl you know, what are you doing with a 15-year-old boy? she played mother. meant no harm by it. d i -- at that point on, i don't know what else happened and how this boy got so angered and rode his bike three miles, okay, to meet with my niece and do what he did to her. i mean, i would think after three miles you would calm down. but he was enraged. and i just -- my family and myself, we're just beside ourselves. we just don't understand it. we're hoping this is just a bad dream and we're going to wake up. >> so far, ratley has had two surgeries, one to remove a piece of her school because of brain swelling and another to remove a blood clot. doctors say they're not sure about her long-term prognosis just yet. a canadian university has canceled a conservative

the family of a seaworld trainer is plead with a judge not to make videos of the deadly encounter public. media organizations argue the video is a public record and should be released. e judge hasn't made a final decision. he's keeping the videos sealed for the time being. so we want to know. do you agree with the court ghaerg relea barring the release of the video? richelle carey joins us now. people are saying i don't want to see this and i don't want my kids seeing it either. >> that's been the majority of the responses we've seen so far. most saying they don't see any purpose to releasing these videos. we'll share both sides nevertheless. let me share some comments from

my facebook page. here's a few. amanda wrote this. how is this video different from any other video that shows a horrible occurrence? seaworld is a public place and the people have a right to know exactly what went on there. annette says i think it's horrible that our society is so twisted that this is even an issue. it's ridiculous to cause this family more pain to satisfy people's sick curiosity. let this family mourn in peace. john paul says it's a state law, whether it be a law versus a human or a multimurderscene. it's the law. and even if it wasn't, don't act like you guys don't ever watch anything worse. and most of the time you pay money to see it. so jonpaul is telling people to look in the mirror there. peggy is calling us from texas. you are one of the few people that actually has reasons you think we should see the tape. go ahead. >> caller: i believe it shouldn't be blocked. she worked in a public place. cameras were filming all the time. they were filming the upside.

tim miller who gave a sworn statement. >> it's really important. that deposition is within all these papers. look at this. it's almost 1,000 pages of reading. and that's what discovery is all about. well, nestled in the middle of that is a deposition from timothy miller. he is the director of equusearch, nationally renowned search group. he says in this deposition that he went orlando. he got a call from cindy anthony. he went and bought a map. he went to the family's home. they were all there. let's show everybody what he says in this depositn. he says "well, apparently george went in and talked to casey and told casey that we were going to start searching fo other areas to go ahead and eliminate them. and i remember cindy was again not real happy. she wasn't being ugly then, but you could tell that her mood certainly took a terrible change and not for the better. george sat down at the table. i had that map and george said to casey, he said, casey, where do they need to start searching?

would you make a spot on the map? would you make an "x." would you make a spot on the map. cindy really got angry then. casey got up and went back to her room. and i looked at george and i think i just kind of threw my hands up. and i said you know, i'm sorry. we really didn't come to cause any trouble or something to that effect. and then cindy asked us to leave and it certainly wasn't a friendly way she asked us to leave." so that's part of the deposition from timothy miller, tim miller, texas equusearch. prosecutors will say parts of this are very relevant. then you have another side. and last night on nancy grace, leonard padilla, who was the bounty hunter in all of this. he spent a lot of time at the family home. he disagrees with the sworn deposition. take a listen. >> i'm not saying it couldn't have. it didn't. >> so you don't think there was ever a time that miller was there that your people were not there? >> absolutely not.

>> and christi, the sworn deposition by timothy miller was very specific. and when you have things that are very specific, and he really has no reason to lie in all of this, right? but very specific can lend to credibility. >> was there anything nels the document that really stood out to you? >> you know, there was. there were pages and pages from the equusearch searchers that search for the body. first of all, it's amazing how many of them were right there where the body ultimately was found. but i guess it makes sense because the family lived down the block, basically. but searcher after srcher corroborates there was so much water right where the remains were found. but there is one searcher that says that a friend of the family's private investigator came up to them saying that he had heard from someone. now this is hearsay upon hearsay that casey anthony's car was right along that street right off where the body was found with the trunk up and it was before any call was made that caylee was missing.

>> i want to move on real quickly to the seaworld documents and the pictures and video thateople are talking about today. they will -- the temporary injunction to keep those under seal was continued by the judge today. but we're asking people, should it be released, as some people, even animal activists are fighting to release this video. is there a precedent? under law, obviously, they could release this. but is there a precedent to do this when it's something as gruesome as this is going to be? what's the point in anybody seeing this? >> there's a law leaning towards not releasing it, at least right now or striking a compromise. dale earnhardt, the race car driver in florida, leading case in florida to say that autopsy photos are private. in the hearing today iwatched it. and there was even testimony about the destruction of the "challenger" and the audiotape when the challenger actually blew up. what happened was they released a transcript of it but never the actual audio recording. and it's the right of the public

being part of a team. there's a new sport everyone can play together. dr. sanjay gupta introduces us to sled hockey. >> reporter: matthew and christopher perry don't use skates to glide across the ice. after strapping on pads and a helmet, they sit down into a sled. they are here to practice sled hockey. the sport for both disabled and able-bodied athletes. >> always gives me a good workout. >> ready? >> reporter: the perry twins have mild cerebral palsy which affects their balance and strength. until now, team sports were just no fun. >> it's not only that they get to participate in a team sport. it's a sport that they can be good at. >> oh, yeah. >> reporter: many team members have physical or mental disabilities. but on the ice, their able-bodied friends or siblings don't have much of an edge. >> they're all on the same level, playing, having fun together. that disability just kind of

they be in my home, whether they be in my workplace, or in this case, in the academy, to put them where they belong. and that is behind bars. >> the head mistress claimed the abuse allegations were never brought to her attention. she was later suspended and then fired from her job. the settlement heads off a trial that was supposed toegin in philadelphia next week. a new hampshire jewelry store owner still cannot believe the thief got away with it. a man snatching an $8,000 ring while the owner and a customer stood just a few feet away. it's all there in the security video. >> ridiculous. i don't know how else to describe it. very brazen. for the life of me, i can't understand how he didn't get caught or seen. >> police released the video in the hopes someone is going to recognize the guy and turn him in. some local officials want to take toys away from kids. they say they want to make youngsters healthier. find out why they think the toys

president obama will sign an executive order this afternoon ensuring the new health care overhaul does not change tight restrictions on federal funding of abortion. he promised the in order a last-minute deal to get support from democrats opposing abortion. current restrictions ban federal funds for abortions except in limited cases such as when a mother's life is in danger. an ohio man suspected of killing 11 women is in court today for a pretrial hearing. anthony sowell faces 85 charges, including murder, rape and kidnapping. police say the remachbs sowell's victims were found in his cleveland home and that seven of them still had string cord or wire wrapped around their necks. sowell has pleaded not guilty by reason of insanity and could face the death penalty if convicted. pittsburgh steelers' quarterback ben roethlisberger will not be giving a dna sample to police. investigators have withdrawn the dna request saying they no longer need it. a 20-year-old woman claims roethlisberger sexually assaulted her at a nightclub in georgia earlier this month.

roethlisberger denies it, and he has not been charged with a crime. now earlier this month police said they were making plans to interview the quarterback. this is all compound by a complaint filed last year by a woman against roethlisberger in lake tahoe, nevada. she claims he sexually assaulted her at casino. in a statement, roethlisberger denied the assault took place saying he'd, quote, never, ever force myself on a woman, unquote. roethlisberger has won two super bowls and he's been -- since he's been with the pittsburgh steelers. a safety warning about baby slings has turned into a recall now. please listen up here. more than a million baby slings made by infantino are being recalled because of claims linking them to three deaths. federal officials say stop -- altogether stop using the slingrider and wendy balisimo slings for babies from newborn to 4 months old. babies can suffocate if they turn toward the parent. they can be smothered. the slings were sold at a lot of stores including walmart,

target, babies "r" us and amazon.com. if you contact infantino they'll replace it with another product but not a sling. earlier this month, federal safety officials warned about these bag-style slings. they didn't, at the time, name a particular brand. how about this for making fast food less appealing to kids? lawmakers in santa clara county, california, voted unanimously to consider banning some fast food restaurants from giving out toys with kids' meals. the president of the county board says it shouldn't stop there. >> the hope is that if we're able to get it approved and people can see the impact that other cities and other jurisdictions not only in santa clara county but throughout california would then undertake similar ordinances. >> i think the resources would be better spent in an area of education because, until we influence the people bringing the kids to mcdonald's, it doesn't matter whether you have a toy in there or not.

>> if approved, the ordinance would only apply to unincorporated parts of the county. the california restaurant association opposes it. oscar winner sandra bullock is not shopping for a divorce lawyer. her representatives tell cnn the stories that are circulating on the internet are not true. now she has cancelled several public appearances since news broke that her husband, a reality tv star jesse james, carried on an affair with a model while bullock was making the movie that won her the oscar. >> sandra learned about this from a tabloid from a tabloid only hours before the tabloid took the story public. you know, to sort of be ambushed in that way, she was completely stunned and she confronted jessie and left their home fairly soon thereafter. so it was a huge revelation, a huge upset and she acted pretty quickly. >> "people" magazine reports

suspended at a bail hearing last month. he was ordered not to use anesthesia on patient. we talked to vinnie politan, the host of "in session" on our sister network trutv. what is the attorney general? is he being asked by the medical board? >> jerry brown is asking for the license to be suspended in california. he's the one bringing this action against dr. conrad murray and some people are saying he's doing it because he's running for governor. this is an issue he's taken up for a while, going after doctors providing pills and potions to anyone who has some money who wants them. so that's dr. jerry brown doing it, but i don't know how much impact it will have on dr. murray. he's not practicing medicine in california anyway. >> they stripped him of his license. isn't that suggesting he's done something wrong? >> that's what the defense really is afraid of, that the court of public opinion will say, well, you know what? they took his license away. this guy did something wrong so when it's time for him to stand trial in his criminal matter that it may be held against him,

we just had some surveillance video just in. this is in suburban tampa. police are looking for a man they said robbed a motel nightclub, stabbing the clerk. hills borough deputy says this video shows that the suspect in action at the red roof inn monday night right by the state fairgrounds. you can see the man has a baseball hat, a knife confronting the clerk. he was demanding money. two got into a struggle and it ended up with the clerk being stabbed and the man ran offnd left behind the h and the knife. the clerk's in stable condition. the attacker may have been hurt as well during the scuffle.

school said a student continued texting his friends after punching and stopping a teenage girl with his steel-toed boots until she was nearly dead. the boy attacked josie lou ratley in deerfield beach. she's in the hospital in critical condition. the broward county sheriff said the text enraged the team and he texted back i'm coming over there and i'm going snap your neck. the teen sent another message to his friends that said well, i guess i'm going to prison. i almost killed somebody. the incident started after ratley loaned her phone to a 13-year-old girl. polices said she's the one who pointed out ratley to the suspect. they laterrrested the 13-year-old and charged her as accessory to attempted murder. ratley's aunt says the niece barely knew the girl, but wanted to help her. >> this little girl is just an acaintance of hers, someone she was nice enough to lend the

of equisearch came to finding caylee anthony. what have we learned from they equisearch comments that were revealed in the documents? was she about to tell them where the remains were? >> think you're talking about timothy miller. his sworn statement is included in that. he's the head of equisearch, texas equisearch, it's a national search agency and this was an interview, a sworn interview under penalty of perjury and that's why we should take this seriously. he talks that cindy anthony called him and asked him to come to florida. he went to florida and initially went and bought a map because he wasn't familiar with the orlando area. he went to the house. the whole family was there. let's show everybody what he says in this sworn interview. he says, quote, apparently george went in and talked to casy and told casey that we was going start searching for other areas to go ahead and eliminate them, and i remember cindy was not real happy. she wasn't being ugly then, but you could tell that her mood certainly took a terrible change, and not for the better.

starbucks, for instance, is one company that wants to see the system changed. now the coffee giant says it spends more on health care than it does on coffee beans. cnnmoney.com's poppy harlow is in new york. boy, that's an image, poppy. >> reporter: yeah, it's hard to believe that starbucks spends more on the health care than the coffee they sell but it is the case. they spend $300 million a year providing health care. part of that is because it is a company unlike a lot of others that gives and offers health care insurance to its employees as after they've been there 90 days and if they work at least 20 hours a month. that's something you don't see in some other places, but the reason for it is interesting. we went to seattle. we sat down with the ceo, you see him there, howard schultz. one of the things that we talked about is health care reform. take a listen to his story. >> i grew up in brooklyn in the projects, which is sunset housing. my parents were great, work-class people, but at the same time you know as we grew up, i think realize that we were

"people" magazine does quote a friend of sandra's of saying "at least for right now, sandra needs time to grieve and process what has happened.

doctors and prescription shopping and all of that so that's been a big issue for jerry brown as attorney general and that's part of the reason i think he's doing that, part of it is politically motivated. it gives him a headline. we're talking about it. a lot of people are talking about it. but for dr. conrad murray, he's not really practicing in california. that's not where his day-to-day practice is. so -- >> in texas, right? >> texas and nevada as well. so it's not going to impact him that way. but where it impacts him is in the court of public opinion. and that is the real concern for dr. conrad murray here. >> that was my question. in terms of jurors, once they sit down in this courtroom, what is the bearing, i guess? what's the connection. >> what it is, it it is the headline today, they're talking about it, taking away, yanking away his license and if his license gets yanked away well, he did something wrong. you go from point a to point b. if a judge has already said he's done something wrong and has taken away his license, and the attorney general's after him it doesn't help him so you've got to find jurors now, if, in fact,

this is the way it plays out, can put this aside. >> this is an unprecedented case and the scope of it because it is involving michael jackson obviously. is there a precedent, is it common for a doctor who is under this kind of scrutiny to have his license pulled before he's even been convicted? because we need to point out that this man's not convicted of anything. >> absolutely, it's two different jurisdictions you're talking about, your license to practice law, versus your liberty. your ability to do whatever you want. to walk around the streets of california or walk around anywhere else. if, in fact, they take his license away okay he can't practice medicine in california and it's a different level of burden of proof. in a criminal case to prove that he did something here illegal and criminal, it's a reasonable doubt. to take away his license it's much less of a burden. will he fight this? probably not because he doesn't practice in california anyway and i doubt he wants to speak about this before he gets in front a criminal judge in a criminal court. >> by the way, the state medical board will make its argument to a jij at murpry's next hearing

a six-inch knife and a black leather tennis shoe. the clerk, by the way, is in stabile condition. and we've learned former new york mets' pitch ever dwight gooden was arrested after a k cared whicar accident in new jersey. gooden has a long history of drug, alcohol and domestic abuse-related arrests. he's facing a long list of charges now, include a dui, endangering the welfare of a child and leaving the scene of an accident. we don't know, though, whether anyone was hurt. pittsburgh steelers' quarterback ben roethlisberger will not be giving a dna sample to georgia police. his attorney tells cnn investigate office have withdrawn that dna request, saying they no longer need it. a 20-year-old woman claims roethlisberger sexually assaulted her at a nightclub in georgia earlier this month. roethlisberger denies it, hasn't been charged with the crime, point out. earlier this month, though, police said they were making plans to interview the quarterback.

drug, alcohol, and domestic abuse-related arrests. he's facing a long list of charges, including a dui charge, endangering the welfare of a child, leaving the scene of the accident. we don't know if anyone was hurt. pictures and video that is show the drowning death of a whale trainer at seaworld will not be made public just yet. an orlando judge is extending the temporary restraining order that keeps the images sealed. this decision is not final. police collected the videos and picture investigating the death of dawn brancheau last month. her family appeared in court to make a personal appeal for the judge to prevent them from going public. media outlets argue these were public records that were used by the police in their investigation. they say the state's open records act requires they be made public. the judge is keeping the temporary injunction in place as he decides whether to make it permanent. police at a florida middle school say a student continued texting his friends just after allegedly punching and stomping a teenaged girl with steel-toed boots until she was nearly dead.

they say the 15-year-old boy attacked 15-year-old josie lou ratley outside their school last week. she's in critical condition. the broward sheriff says the text message from ratley apparently enraged the teen. he texted back, i'm coming over there and i'm going to snap your neck. the sheriff says after the attack the teen sent other message to his friends that read, well, i guess i'm going to prison. i almost killed somebody. the incident apparently started after ratley loaned her phone to a 13-year-old girl. police say she's the one that pointed out ratley to the suspect. they later arrested that 13-year-old. ratley's aunt told hln's jane velez-mitchell that her niece barely knew the girl but wanted to help her. >> this little girl is just an acquaintance of hers, someone she was nice enough to lend the phone to, and became a victim over, you know, an issue where -- one thing about my niece i have to say, she's a

welcome back. businesses big and small are paying close attention to health care reform and what it means for their bottom line. starbucks wants to see the system changed. the coffee giant says it spends more on health care than on coffee beans. cnnmoney.com's poppy harlow in new york tells us more about starbucks and health care. poppy, hi. >> it's hard to believe that a coffee company would spend more on health care but starbucks says it spends $300 million a year on health care. one of the reasons for that is they're different than a lot of other companies in their sector in that they offer health insurance to their employees after they work there for three months and the part timers, too, people who work 20 hours or more a week. the baristas behind the counter. when we talked to the ceo about their business, health care, all of it, he took back to his childhood and talked about why he refuses to give up providing that health care at the company despite the cost. pretty interesting story. take a listen. >> i grew up in brooklyn in the
